On May 31st, it was reported that a baseball fan had filed a personal injury lawsuit against the Los Angeles Angels after being struck in the face by a baseball. Almost one year prior to the lawsuit being filed, this individual had attended a baseball game with the hopes of forgetting his troubled life for at least a few innings. His father had just passed away despite surviving the holocaust, and he had just been diagnosed with brain cancer.
When the victim glanced down to grab a few more peanuts from his snack bag, tragedy struck. A Los Angeles Angels player decided to hurl a baseball into the stands at high velocity in a strange celebration, and the ball flew straight into the victim’s face while he was distracted by his snack.
The impact caused a completely crushed eyeball, and it occurred with such force that the internal fluid within his eye burst. The globe of the eye was completely ruptured, and extensive surgery was not enough to save it. Unfortunately, the plaintiff was already semi-blind in his right eye, which means that his now permanent blindness in his left eye leaves him with almost no sight. This has left him unable to perform even basic tasks. Even after the surgery, the plaintiff complains of a constant stabbing pain in his left eye area.
The baseball organization claims that the ticket for each attendant clearly warns of potential injuries due to the nature of baseball. However, the plaintiff states that this is just “fine print” and that no one actually reads it. The plaintiff’s attorney also points out that this injury occurred after play was stopped, so it does not represent the normal nature of baseball indicated by the disclaimer anyway.
